Klehr Harrison Obtains Complete Defense Verdict in Multi-Million Dollar Claim Arising Out of the Sale of a Delaware County Business

In the case of Medical Consultants Network v. Maloney et al,  Patricia Maloney was sued by MCN for fraud, breach of contract and breach of fiduciary duty in connection with the sale of the assets of her company, Villanova Rehabilitation Consultants, to MCN (a Seattle Company) for $6 million.  MCN claimed that she had concealed material facts about VRC prior to the sale.  Maloney counterclaimed for breach of the asset purchase agreement and also sued MCN’s owner for defamation.  The case was in discovery for 3 ½ years.  After a 10 day non-jury trial from September 30 to October 14 before the Honorable Kathrynann W. Durham, of the Delaware County Court of Common Pleas, the judge issued a decision on February 26, 2003, in favor of Maloney on all of the plaintiffs’ claims and in favor of Maloney and VRC on their counterclaims.  The Court dismissed the claim for defamation.
